These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "Player", or "you") and Fireholder Game Corp. ("Fireholder", "Company", "we", "us", or "our") governing your installation, access, and use of all mobile games, software applications, websites, and associated services (collectively, the "Services").
IMPORTANT NOTICE: Please review Section 8 below carefully. It contains a binding arbitration agreement and class action waiver that affects your legal rights concerning any disputes with Fireholder Game Corp.
1. Agreement to Terms & Eligibility
By accessing, downloading, installing, or playing any game published by Fireholder Game Corp., you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.
You represent that you are at least the age of majority in your jurisdiction, or, if you are a minor under the laws of your jurisdiction (typically 13 to 17 years old), that your parent or legal guardian has reviewed and consented to these Terms on your behalf. If you do not agree to these Terms, you must immediately uninstall and cease all use of our Services.
2. Limited End-User License & Intellectual Property
Subject to your strict compliance with these Terms, Fireholder Game Corp. grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download and install a copy of our mobile games on an Android mobile device that you personally own or control, solely for your personal, non-commercial entertainment.
All rights, title, and interest in and to the Services—including but not limited to proprietary physics solver source code, 3D vehicle models, CAD kinematics assets, hydraulic simulation algorithms, audiovisual works, trademarks, logos, and UI sound effects—remain the exclusive intellectual property of Fireholder Game Corp. and its licensors. No ownership rights are transferred to you under any circumstances.
3. Prohibited Conduct & Anti-Cheat Policy
When interacting with our Services, you strictly agree NOT to:
- Decompile, disassemble, reverse-engineer, or attempt to derive the source code or underlying mathematical solvers of our applications.
- Distribute, inject, or execute unauthorized modified APK binaries, memory trainers, aimbots, physics override modifications, or game speed hack tools.
- Exploit software bugs, unconstrained collision geometries, or in-game economic errors for unauthorized virtual rewards or competitive advantage.
- Circumvent or tamper with in-app purchase verification, advertising mediation gates, or digital rights management (DRM) technologies.
- Use automated bots, spiders, or scripts to harvest telemetry, simulate fraudulent ad impressions, or degrade server infrastructure.
4. Virtual Items & Billing via Google Play
Our games may offer you the opportunity to license virtual items, coins, customization liveries, or ad-removal subscriptions ("Virtual Items"). All financial transactions for Virtual Items are processed exclusively through Google Play In-App Billing under Google's Terms of Service.
Virtual Items are licensed to you on a limited, revocable basis; they have zero cash value and do not constitute personal property. Virtual Items cannot be transferred, exchanged, redeemed, or refunded for real currency, except as mandated by applicable statutory consumer protection laws or Google Play Refund Policies.
5. Telemetry & Device Performance
To guarantee high frame rates (60–120 FPS) and accurate multi-body constraint solving, our software may collect anonymous, non-personal diagnostic telemetry including GPU renderer capability, Vulkan API version, memory bandwidth, and frame delta jitter. This diagnostic data is processed in strict adherence to our Privacy Policy and Google Play Data Safety guidelines.
6. Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED UNDER APPLICABLE LAW, THE SERVICES ARE PROVIDED STRICTLY ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. FIREHOLDER GAME CORP. EXPLICITLY DISCLAIMS ALL WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, QUIET ENJOYMENT, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT THE OPERATION OF THE SERVICES WILL BE ERROR-FREE, UNINTERRUPTED, SECURE, OR FREE FROM HARMFUL COMPONENTS, OR THAT VEHICLE SIMULATION CALCULATIONS WILL CORRESPOND TO PHYSICAL REALITY IN INDUSTRIAL USE-CASES.
7. Limitation of Liability & Indemnification
IN NO EVENT SHALL FIREHOLDER GAME CORP., ITS DIRECTORS, EMPLOYEES, AFFILIATES, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING LOSS OF PROFITS, DATA, USE, GOODWILL, OR HARDWARE MALFUNCTION) ARISING FROM OR RELATED TO YOUR USE OR INABILITY TO USE THE SERVICES.
OUR AGGREGATE TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICES SHALL UNDER NO CIRCUMSTANCE EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU PAID TO FIREHOLDER GAME CORP. IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) FIFTY UNITED STATES DOLLARS ($50.00 USD).
8. Governing Law & Dispute Resolution
8.1 Governing Law: These Terms and any dispute, controversy, or claim arising out of or related to them or the Services shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without giving effect to any principles of conflicts of law that would require the application of the laws of any other jurisdiction.
8.2 Mandatory Informal Dispute Resolution: Prior to initiating any formal legal or arbitration proceeding, you and Fireholder agree to first attempt to resolve any dispute informally. You must deliver a written Notice of Dispute detailing your name, contact information, facts of the claim, and requested relief to [email protected]. Both parties agree to engage in good-faith negotiations for a minimum of thirty (30) calendar days from receipt of such notice.
8.3 Binding Individual Arbitration: If the dispute is not resolved during the informal period, it shall be resolved by final and binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration hearing, if held in person, shall take place in Dover, Delaware, or another mutually agreed venue, or may be conducted via remote videoconference.
8.4 Class Action Waiver: YOU AND FIREHOLDER GAME CORP. MUTUALLY AGREE THAT ALL CLAIMS MUST BE BROUGHT SOLELY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. THE ARBITRATOR MAY NOT CONSOLIDATE MORE THAN ONE PERSON'S CLAIMS.
8.5 Exceptions: Notwithstanding the foregoing, either party may bring an individual action in small claims court having competent jurisdiction, or seek preliminary injunctive relief in a court of competent jurisdiction to protect intellectual property rights against infringement or misuse.
9. Modifications to Terms
Fireholder Game Corp. reserves the right to modify these Terms periodically to reflect updates in legal requirements, game features, or operational practices. When material updates are made, we will revise the "Effective Date" at the top of this document and provide notice within our applications or website. Continued use of our Services following such notice constitutes acceptance of the revised Terms.
